1. Description of this document

This document sets out the Terms and Conditions (hereinafter “the Terms”) governing the use of the services and products provided by m&h (hereinafter “the Studio”). By accessing our website and using our services, you agree to be bound by these Terms.

2. Definitions of certain terms

  • The Studio: Refers to m&h, the company providing the services and products.
  • User: Any natural or legal person who uses the services or accesses the Studio’s website.
  • Services: Designates all services offered by the Studio, including, but not limited to, consulting, production and management of projects.

3. Intellectual property

At m&h, we understand the crucial importance of intellectual property in protecting the unique creations developed in our studios. In recognition of this, we give top priority to the ownership and security of all project files produced for our clients. Every file generated during our collaboration is the intellectual property of the client and is stored in our secure archives, which are protected by rigorous standards.

4. General terms of collaboration

The services provided by the Studio are subject to specific contracts defining the particular terms of each collaboration. In the event of a conflict, these contracts shall prevail over these Terms. Users agree to provide accurate and complete information and to cooperate fully with the Studio in the provision of services. Invoices issued by the Studio must be paid within the deadlines stipulated in the contract. To terminate a contract with the Studio, the client must inform us in writing, in accordance with the terms in the contract. Please note that the client will be billed for any hours already worked up to the notification date.

5. The Studio’s responsibility

Our monitoring methods ensure that the time spent on each project is appropriate, that rare overruns are justified and announced ahead of time, and that the price you pay for each project is fair and within the allocated budget. Our rigorous administrative system also ensures that projects are closed and invoiced monthly so that no backlogs accumulate and cause budget deferrals between fiscal periods. The Studio undertakes to provide its services with diligence and professionalism; however, it cannot guarantee the absence of errors or defects in its services. The Studio shall not be held liable for any indirect, consequential or special damages arising from the use of its services.

6. Links to other sites (third-party websites)

The Studio’s website may contain links to third-party websites. These links are provided as a convenience, and the Studio does not monitor these sites. The Studio assumes no responsibility for the content, security or practices of these third-party sites.

7. Applicable laws and jurisdiction

These Terms shall be governed by and construed in accordance with the laws in force in the province of Quebec, Canada. Any dispute relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts located in Montréal, Quebec.

8. Limitation of liability and warranty

The Studio declines all responsibility for any damage resulting from the use of its services or from the inability to use them. The Studio does not warrant that its services will be uninterrupted, secure or error-free. Any use of the services is at the User’s own risk.

9. General

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The Studio’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

10. Modifications to the terms and conditions

The Studio reserves the right to modify these Terms at any time. Modifications will take effect as soon as they are published on the Studio’s website. It is the User’s responsibility to consult these Terms regularly to keep abreast of any modifications.
